Terms of Service

Effective August 8, 2026

These Terms govern your access to and use of Fostr’s websites, progressive web application, and related services. By creating an account or using Fostr, you agree to these Terms. If you do not agree, do not use the service.

Medical and emergency notice

Fostr is a logging and educational tool. It is not a medical device, healthcare provider, diagnostic service, or emergency service. Do not rely on Fostr to make medical decisions. Contact a qualified clinician for medical concerns and local emergency services for urgent help.

1. Eligibility and family authority

You must be at least 18 years old, or the age of legal majority where you live, to create a Fostr account. Fostr is designed for parents, legal guardians, and other adult caregivers; it is not directed to children.

When you add information or media about a child, you confirm that you are authorized to do so. When you invite another caregiver, you confirm that you are authorized to give that person access to the child profile.

2. Accounts and caregiver access

You must provide accurate account information, keep your credentials secure, and notify us if you believe your account has been compromised. You are responsible for activity performed through your account.

Child profiles may be shared with invited caregivers. Caregivers can see and interact with information made available through that shared profile according to Fostr’s current permission model. Profile owners are responsible for choosing trusted caregivers and removing access when it is no longer appropriate.

3. Acceptable use

You may use Fostr only for lawful personal and family purposes. You may not:

  • upload content you do not have permission to use;
  • impersonate another person or misrepresent your authority over a child profile;
  • attempt to access another family’s account or bypass security, usage limits, or safety controls;
  • use Fostr to create abusive, exploitative, sexual, deceptive, or otherwise unlawful content;
  • reverse engineer, disrupt, overload, scrape, or misuse the service; or
  • resell or commercially exploit Fostr or its outputs without written permission.

4. Tracking, estimates, and AI-assisted features

Fostr may summarize logs, estimate routine timing, prefill forms from voice transcripts, and generate educational text. These features can be incomplete, inaccurate, delayed, or unsuitable for your situation. Review all AI-assisted content and voice-prefilled forms before relying on or submitting them.

Fostr does not guarantee that a child will feed, sleep, wake, develop, or behave according to an estimate. You remain responsible for caregiving decisions and for confirming important information with an appropriate professional.

5. Your content and the licence needed to operate Fostr

You retain your rights in information, photos, videos, notes, and other content you submit to Fostr. You give Fostr a limited, non-exclusive licence to host, copy, process, transmit, display, resize, and otherwise use that content only as needed to provide, secure, maintain, and improve the service for you. This licence ends when the content is deleted from active systems, subject to limited backup, security, and legal retention described in the Privacy Policy.

You are responsible for your content and for obtaining any permissions required from other adults or caregivers depicted or identified in it.

6. Portrait Studio

Portrait Studio uses generative AI to transform a reference photo. You confirm that you have the right and appropriate parental or guardian authority to upload every reference image.

Generated portraits may vary from the reference, contain errors or visual artifacts, and may not be unique. Subject to applicable law and third-party rights, you may use and download portraits generated for your account for personal purposes. Fostr does not promise that exclusive intellectual-property rights exist in any AI-generated output.

Promotional or early-access credits may be limited, reset, or expire as described in the app. Credits have no cash value and may not be transferred. A credit deducted for a generation that fails within Fostr’s processing pipeline is intended to be returned automatically.

7. Subscriptions, private beta access, and credits

The standard monthly Fostr family plan is currently priced at CA$9.99 in Canada and US$6.99 in the United States, plus applicable taxes. The price, included features, renewal schedule, cancellation method, and any refund terms will be shown and confirmed before you purchase.

Families invited into the private beta may receive complimentary access during the evaluation period. Private beta access is limited, may change or end, and does not guarantee that every feature will remain free or unchanged. A beta account will not be converted into a paid subscription or charged automatically without your affirmative agreement.

Portrait Studio credit packs may be offered separately from the family subscription. Credit quantities, prices, expiry or reset rules, and any applicable refund terms will be shown before purchase.

8. Availability, changes, and data exports

We work to keep Fostr available, but uninterrupted or error-free service is not guaranteed. Features may change, be suspended, or be discontinued for security, legal, technical, or product reasons.

Fostr should not be your only copy of information you must preserve. Keep independent copies of important medical documents, memories, and downloaded portraits. Fostr logs are not a substitute for official medical records.

9. Privacy, deletion, and termination

Our Privacy Policy explains how Fostr handles personal information. You can delete individual entries, child profiles, and your account using available in-app controls.

We may restrict or suspend access when reasonably necessary to protect users, children, Fostr, or the public; investigate suspected misuse; comply with law; or enforce these Terms. Where practical, we will provide notice and an opportunity to resolve the issue.

10. Fostr intellectual property

Fostr’s software, branding, interface, original copy, templates, and other service materials are owned by Fostr or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of those materials to you.

11. Disclaimers

To the extent permitted by law, Fostr is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

12. Limitation of liability

To the extent permitted by law, Fostr and the people involved in providing it will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or opportunity arising from use of the service. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

13. Changes to these Terms

We may update these Terms as Fostr changes. We will update the effective date and provide reasonable notice of material changes through the service or by email when appropriate. Continued use after the revised Terms take effect means you accept them.
